จากกรณีที่เว็บประชาไทถูกสั่งบล็อคด้วยหมายศาล ตอนนี้ได้มีการเปิดเผยหนังสือคำสั่งจากนายสุเทพ เทือกสุบรรณ ผู้อำนวยการศูนย์อำนวยการรักษาความสงบเรียบร้อย (ศอ.รส.) ไปยังรัฐมนตรีว่าการกระทรวงเทคโนโลยีสารสนเทศและการสื่อสาร ลงวันที่ 7 เม.ย. พ.ศ.2553 เพื่อให้ปิดกั้นเว็บไซต์ 36 แห่ง (รวมประชาไทแล้ว) โดยระบุว่ามีการเผยแพร่ข้อมูลข่าวสารที่อาจส่งผลต่อความมั่นคง
เพราะฉะนั้น การที่เว็บไซต์ 36 แห่งถูกปิดกั้นจึงไม่ใช่คำสั่งศาลแต่อย่างใด แต่เป็นการดำเนินการของ ศอ.รส. โดยใช้อำนาจตาม พรก.การบริหารราชการในสถานการณ์ฉุกเฉิน พ.ศ.2548
สังเกตได้ว่าเว็บไซต์ทั้งหมดที่ถูกปิดกั้นในครั้งนี้ มีความเกี่ยวข้องกับแนวร่วมประชาธิปไตยต่อต้านเผด็จการแห่งชาติ (นปช.)
